More than a century ago, the new Civil Code succinctly settled the question regarding notaries: "The cantons shall regulate the manner in which public deeds are drawn up on their territory." This special form ("forme qualifiée") remains at the heart of the most important institutions of private law. Notarial law has constantly evolved because of the contributions of doctrine and case law.
