More than a century ago, the new Civil Code succinctly settled the question regarding notaries: "The cantons shall regulate the manner in which public deeds are drawn up on their territory." This special form ("forme qualifiée") remains at the heart of the most important institutions of private law. Notarial law has constantly evolved because of the contributions of doctrine and case law. The book provides an overview of the situation by describing the obligations incumbent on all notaries, in addition to the special features applicable in each canton. It outlines recent developments in competition law, EU law, emerging computer technologies and tax law. It also includes a summary of the cantonal laws of the French-speaking cantons that describes the provisions on liability, remuneration and access to the profession that apply in each canton.
